Chinese smartphone-maker Shenzhen OnePlus Technology Co Ltd has told the Delhi high court that its version of the Cyanogen operating system (OS) is different from the one that Micromax has an exclusive licence to use in India.
OnePlus was recently restrained by the high court from selling its devices in India on Gurgaon-based phonemaker Micromax Informatics Ltd's plea that its exclusive rights were being infringed by the Chinese company.
The Chinese company said that while its handsets were embedded with the CM11S version of the Cyanogen software, Micromax had a different version, and added that this point was not submitted before the single judge who had passed the restraining order.
It also argued before a bench, headed by Justice Pradeep Nandrajog, that the exclusivity clause in the agreement between Micromax and US-based software firm Cyanogen only means that Cyanogen cannot collaborate with any another mobile maker in India.
"It does not mean that we cannot do business," senior advocate Kapil Sibal, appearing for Shenzhen, said.
He, however, suggested that his client be given three months time to sell its stock as well as develop another software to substitute Cyanogen, a custom software based on Android operating system.
The matter was listed for further hearing tomorrow. During the proceedings, the bench observed Cyanogen has not been fair to both Shenzhen as well as Micromax as the US-based firm entered into an exclusive use agreement with the Indian company when it already had an arrangement with the Chinese phone-maker.
"Your client (Cyanogen) did not show fairness to either Micromax or Shenzhen. If this is how you want to proceed, that is wrong," the bench said to the counsel for the US firm.

LG Fx0 - the first smartphone with a transparent body unveiled

In a first of its kind, a smartphone with a transparent body was unveiled by non other than LG. The handset, called LG Fx0, was made by LG in association with Firefox which will go on sale in Japan from Thursday.
The LG Fx0 runs on Firefox OS 2.0 and has been designed by Tokujin Yoshioka, a noted artist and designer. As per the reported images, the LG Fx0 has transparent front, side and back panels while the home button of the smartphone is printed with a golden Firefox logo. So as is seen in the images, you can see the battery and other internals of the phone.
Roughly priced at about Rs 26,300 (50,000 Japanese Yen), the Fx0 offers a a 4.7-inch IPS display, a quad-core 1.2GHz Qualcomm Snapdragon 400 (MSM8926) processor, and 1.5GB of RAM. It has 16GB of inbuilt storage, which is expandable via a micro SD card to up to 64GB.
There is an 8-megapixel camera and an LED flash in the Fx0 which has a 2.1-megapixel front facing camera. The 139x70x10.5mm measuring handset has a 2370 mAh battery, and it weighs 148 grams. Apart from that the LG Fx0 offers 4G LTE and NFC support.
Till now only cheap Firefox OS based smartphones have been launched in India that includes the Intex Cloud FX, Zen U105, and Spice Fire One.
As far as transparent smartphones are concerned, though the LG Fx0 is the first of its kind, a prototype was made back in 2013 itself (see image below).
A Taiwanese company, called Polytron, had in February 2014 displayed a prototype of a transparent smartphone which was made by a special type of glass that is light weight and features a transparent screen and body. However, components like battery, camera, micro SD card slot were visible in that device too. In 2011, a transparent Lithium ion battery was developed Stanford researcher, Yi Cui. Hopefully, one day, we may see a completely transparent smartphone!

Delhi High Court lifts the ban on the OnePlus One sales in India
Shenzhen OnePlus Technology Co., otherwise simply known as OnePlus, was recently banned from importing and selling the OnePlus One in India due to an injunction granted to Micromax over the use of Cyanogen branding and software on OnePlus devices. The Delhi High Court has now reversed its decision, allowing OnePlus to continue selling phones in India.
Micromax had filed for an injunction against OnePlus for use of Cyanogen branding and software on the OnePlus One, despite Micromax having an exclusive licensing agreement with Cyanogen for its YU series of phones. The judge had then banned OnePlus from selling phones in India, allowing only to sell the remaining stock they had through its online partner Amazon.
Now judges Pradeep Nandrajog and RK Gauba said in their court order that they have set aside the appeal that banned OnePlus from selling phones in India, and that the case will be heard and decided afresh by a single judge on January 7. Until then OnePlus can continue to sell phones in India.
The problem arose with the original verdict being given after hearing only Micromax' plea. OnePlus was never given the opportunity to present its case, which is what is going to happen on January 7. OnePlus' logical argument is that the Yureka phone Micromax sells costs INR 8,000 while the OnePlus One costs INR 22,000 and thus neither competes with each other. On top of that, OnePlus claims to use the Cyanogen 11s version of the OS, while Micromax is using and has rights to only the Cyanogen 11 version on its Yureka phones.
Cyanogen is also being asked to file a written statement along with OnePlus, which will be presented in court on January 7. The court even branded Cyanogen as the "villain", which all things considered is not an unfair assessment.
